Definitions

i. "Linwar" means Linwar Motors Limited.

ii. "Customer" means any individual, firm, company or other party with whom Linwar contracts for the provision of any its products or services.

Making a Purchase

All contracts of sale or service made by Linwar shall be deemed to incorporate these Terms and Conditions, which shall prevail over any other existing terms or terms from the Customer with whom Linwar is dealing.

The Customer is responsible for the accuracy of the information supplied to Linwar which forms the basis of the order.

All parts remain the property of Linwar until payment is received in full.

Making an online purchase could not be easier. Just browse our store and add any items that you wish to buy into your shopping basket. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept credit card payment. If you are shopping from outside of the UK, place your order and your credit card company will convert the transaction to your own currency. All prices are quoted in GBP Pounds Sterling and all payments must be made in GBP (Pounds Sterling). If chosing bank transfer as a payment option, our bank details are provided once the order has been submitted to us. Stock will be reserved for a period of 10 days pending payment. If payment is not recevied in this time, stock will no longer be reserved and released for general sale again. Incomplete orders are purged from the database after 30 days.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

A Cash Deposit of one-third of the sale price is required where parts are specially ordered by us at the customer’s request.

Some goods (for example cylinder heads) are supplied on an exchange basis, and a refundable deposit will be levied at the time of purchase.

Exchange parts must be handed in at the time of sale, or a Deposit (stated at the time of sale) must be made by the customer. Such Deposit is refundable when the exchange parts are subsequently received by us.

All goods returned by the Customer in exchange for goods supplied by Linwar must be delivered to Linwar in good and clean condition within 30 days of the date of the invoice. Linwar reserves the right to refuse to accept such goods if they are in an unserviceable condition, in which case Linwar will be entitled to retain the deposit.

Shipping Options

This website automatically calculates shipping cost based on the physical weight of the items being purchased. Where available the Customer is given a number of delivery service options at the checkout/payment phase. Some couriers, especially on international consignments, charge by "volumetric weight" which is calculated using the dimensions of the parcel. The volumetric weight is often higher than the physical weight and consequently increases the shipping cost.

Whilst every effort is made to ensure that the shipping quote made by this website is accurate, Linwar is not bound by it and the customer will be notified if the actual shipping cost is higher than quoted. Where available a downgraded/slower delivery service will also be offered in conjunction with the new quote.

Deliveries

Any date or time stated for delivery is an estimate only. Linwar makes every effort to despatch goods on time but does not accept liability for failure to deliver on the stated date.

Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risks of loss, breakage and all damage shall pass to the Customer.

Linwar must be notified of any shortages or damage to delivered goods within 48 hours of receipt of the delivery.

Tax Charges (VAT)

For orders made from the UK, 20% VAT is added to all products with the exception of books.

If you are purchasing on behalf of an EU VAT registered business, please enter your EORI number in the checkout.

VAT is not charged on any item ordered and shipped outside of UK. VAT will be automatically removed in the checkout area when the shipping destination is chosen. Please bear in mind that any applicable local import duty and/or tax will be applied by your local border/revenue service.

Credit Card Security

Returns Policy

Except as hereafter stated, no cash refunds shall be made, whatsoever.

Subject to the right of consumers to return goods under The Consumer Contracts Regulations 2013, Linwar Motors Ltd. does not sell products on a trial basis. Goods which have been used or tampered with will not be accepted for refund for reasons of health and safety. In the event of a fault with a product, the product will be repaired or replaced in accordance with Consumer Rights Act 2015. If no repair or replacement is available, a refund of the original purchase price will be made. Customers are strongly advised to check suitability and specifications of products before ordering.

In the event that Linwar Motors Ltd., at its discretion (unless the The Consumer Contracts Regulations 2013 apply), agrees to accept the return for credit of unwanted products, the goods must be returned with Linwar’s prior written agreement within 14 days of notifying us of cancellation. The goods may not have been used and must be unopened and in perfect resaleable condition.

Some parts are security marked or sealed for your protection and ours. Linwar reserves the right to refuse to accept a return if this security mark or seal has been tampered with or is missing.

Claims that parts supplied are defective must be advised for our attention within 3 working days of the date of sale, unless specific alternative arrangements have been agreed at the time of sale.

USED PARTS offered for sale have been selected as serviceable for the purpose for which they are to be sold, but no guarantee is given. If a used part proves to be defective, our liability shall be limited to free replacement of the part or failing that, refund of the sale price.

RECONDITIONED PARTS A warranty attaching to such parts refers only to the mechanical efficiency of those parts and our liability during the warranty period shall be limited to free replacement of the part. Labour for installation and removal is not subject to warranty and no consequential liability whatsoever can be accepted. In the event of complaint, the customer must:
(a) Advise us promptly, and
(b) Return the part to our premises, out of the vehicle.

Goods can only be returned if prior agreement and authorisation has been obtained from Linwar. Returned goods must be returned with the original invoice and must be received by Linwar within 14 days of delivery in the condition in which they were supplied and in their original packaging. Goods must be in perfect re-saleable condition and will not be accepted for return if they have been fitted.

Parts correctly supplied but returned for credit will be subject to a handling charge of 25% of the value of the goods.

Parts ordered by special arrangement cannot be returned for credit.

Linwar cannot accept liability for packages damaged during transit. It is the Customer’s responsibility to package the goods adequately to prevent damage. Proof of postage is not proof of delivery and you are therefore strongly advised to send your returns by recorded delivery, registered post or courier, and to maintain sufficient insurance to cover the value of the goods.


The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

Contracts for the purchase of goods by a customer not acting in the course of a business and made over the telephone or through the Linwar Motors Ltd’s website, or by mail order, are, with the exception of certain excepted contracts, subject to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (‘the Regulations’).

If the Regulations apply, Customers may cancel goods purchased from Linwar Motors Ltd. by sending a written notice of cancellation by post or hand delivery addressed to Linwar Motors Ltd., 40-44 Virginia Street, Southport, Lancashire PR8 6RU, or by fax to 01704 501753 or by e-mail to Email Us.

The notice of cancellation must be delivered within 14 days of the date of delivery of the goods. Goods must be received by Linwar within 14 days following notice of cancellation.

The Customer will be responsible for the cost of returning the goods if he or she exercises this right of cancellation under the Regulations. If the Customer does not actually return the goods to Linwar Motors Ltd., the Customer is under a duty to make the goods available for collection from the address to which they were delivered. The full cost of recovery of the goods will be deducted from the refund.

The Customer is under a duty to retain possession of the goods whilst awaiting return to Linwar Motors Ltd. and to take reasonable care of them during this period. The Customer will be liable for any loss of or damage to the goods if he or she fails to comply with this obligation.

Core Surcharges

Certain productlines are remanufactured and therefore sold on an exchange basis. In these cases, the product page will have an additional line "Core Surcharge" and an amount. This amount is added to the transaction in the shopping basket (cart). When the old "core" item is returned to us, this surchage will be refunded if the following conditions are met:

a) the core is returned within 60 days
b) the core is complete with no missing parts
c) the main body of the core item, the part we require for remanufacture, is undamaged and suitable for remanufacture.

Privacy Policy

Unless required to do so by law, Linwar does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party (for example the delivery agent) will not disclose any of the details to any other third party.

We do not send any unsolicited marketing emails although you may be given the option to sign upto a newsletter. you may unsubscribe by emailing us via the contact form on this website.

We take all possible reasonable care to keep all your personal details, details of your orders and payment details secure. During the on-line checkout and payment process all communications with our web server are encrypted using SSL technology. In addition to the use of SSL, all credit and debit card details are subjected to additional encryption. All our systems are also protected by firewalls.

Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies. Data collected by this site is used to:
a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Issue a unique identifier (e.g. customer login)
d. Monitor customer account status beyond that required for individual purchases
e. Only disclose information to third-parties for goods delivery purposes

General

The headings are for convenience only and shall not affect the interpretation of these Terms and Conditions.

Nothing in these Terms and Conditions affects your statutory rights, either as a consumer or otherwise.

Where, in spite of its reasonable efforts, Linwar is unable to perform an obligation due to outbreak of war, any Government act, political interference, explosion, fire, flood, accident, riot, industrial dispute or strike, or any other force majeure, it shall not be deemed to be in breach of its contract with the Customer.

If any provision in these Terms and Conditions is held to be invalid, unlawful or unenforceable, it shall be deemed severed from the remaining conditions and provisions which shall continue to be valid to the fullest extent permitted by law.

Any variation of these Terms and Conditions must be in writing and signed by Linwar.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

Linwar reserves the right to change or amend these Terms and Conditions at any time and without prior notice.
